For immigrants, high-speed justice or a legal dead-end?
How fast can you take 300 people to court? The raid of an Iowa meatpacking plant earlier this year was a grim case study in rapid-response law enforcement. Hundreds of workers at the Agriprocessors plant in Postville, Iowa were swept up by federal authorities and within days, swiftly processed and convicted through a makeshift court and detention camp set up at a cattle fairgrounds.
The workers, most from Guatemala and unable to communicate with the court in English, were essentially herded through the proceedings with little understanding of what was happening. In the end, 260 people pleaded guilty -- on the promise of less prison time and a chance to return home sooner -- and received five-month prison terms for using false employment-related documents.
Though officials claim that workers’ rights were respected, the Postville raid signals a shift in immigration enforcement that is shaking up communities from Los Angeles to Long Island.
Before a House panel yesterday, legal observers said the uncanny efficiency of these “fast track” convictions reflects a deeper malaise in immigration policy.
Erik Camayd-Freixas, a court interpreter, recalled at the congressional hearing that during the process, many of the workers
“had trouble understanding the charge of Social Security fraud because they felt they had not done anyone any harm. They simply understood that both were arbitrary charges brought by the government for the sole reason that they were in the country illegally and that, therefore, they had no rights….“Whatever rights they were told they had made absolutely no difference, so they kept insisting that they had no rights because they were here illegally. With their rights being meaningless or denied, and without understanding the nature of the charges against them, they were unable to aid in their own defense.”
David Wolfe Leopold of the American Immigration Lawyers Association called the handling of the Potsville cases “a stain on our justice system":
“The government made the undocumented workers an offer they couldn’t refuse. Faced with the choice of 5 months in prison and deportation, or 6 months in prison waiting for a trial which could lead to 2 years in prison and deportation, what choice did the workers really have? Needless to say the scheme left little room for the fundamental protections offered by the Constitution. The spectacle was a national disgrace.”
While the Postville raid shed light on a growing effort to criminalize undocumented immigrants (in the past, such cases have been dealt with by simply deporting people), the crackdowns continue and federal immigration prosecutions have soared.
Last Fall in Nassau, immigration officials rounded up 186 people based on suspicions of gang-related activity. The action sparked community outrage, prompting civil liberties advocates to legally challenge such raids as a violation of constitutional rights.
Meanwhile, for the employers of the Postville workers, the law seems to move along different lines. In his testimony, Leopold pointed out that Agriprocessors has faced allegations of “serious violations of labor, food safety, environmental and other labor laws.”
Their record of compliance on one legal matter has improved, however. In the wake of the raid, the company's website offered this assurance:
“Our company takes the immigration laws seriously.“We cooperated with the government in the enforcement action. We intend to continue to cooperate with the government in its investigation. Agriprocessors will also inquire further into the circumstances that led to these events.
“We extend our heartfelt sympathies to the families whose lives were disrupted and wish them the best.”

So if I understand Newsday's position, when the government enforces those silly little burdensome laws about identity theft and the fraudulent use of someone elses Social Security # they are being mean spirited? Please show me the area of the constitution that says that a person has to be educated enough or sophisticated enough to understand the elements of the crime they are being charged with. It apparently is of no concern that each and every one of the defendants in this case were afforded FREE legal representation and the use of an interpreter to avail themselves of that free legal representations. The claim that they didn't know what they were doing was wrong is without merit. Besides that, ignorance of the law is NO defense. The criminals in question knew very well that they had no right to use a fraudulently obtained social security number and name and they did it anyhow. That pretty much ends the discussion right there. So I guess by your assertions that the Government after arresting someone shouldn't offer them a plea bargain either or that it apparently is of no concern of yours that the defendants FREE appointed counsel recommended that their clients take the plea offered. There is a simple way not to run afoul of the US legal system..... Don't break the law. Regardless if you think that law is silly, mean spirited or unnecessary.
I fail to see what was wrong with these proceedings. Nowhere in this editorial does Newsday even suggest that any of the defendents were innocent of the charges. It seems that they received justice, swift justice (a rarity nowadays). Maybe Newsday is upset that these illegal aliens did not have an opportunity to game the system.

Last I checked, American cititizens were prosecuted for stealing anything that belonged to someone else and fraud, so I don't have any sympathy for these people.

Newsday never shows any concern for the rights of men when with regard to abusive divorce and alimony laws. Newsday publishes pictures of people arrested, but not convicted, of drunk driving in violation of their rights. Newsday publishes names of sex offenders who have served their time in jail already but are considered criminals for life. Yet, if a criminal alien is deported, Newsday screams about their civil rights. Why do illegal aliens deserve better treatment than US Citizens?
Those trials were a travesty of justice. Every human being deserves a fair chance in court no matter what crime they are accused of, even the crime of working for low wages. The rest of the comments above are from people who simply don't like to see that the complexion of the US is changing.

Newsday, with 99% of the mass media, is a big advocate of illegal immigration. So of course it is against any effective form of immigration law enforcement. Their goal is to have the deportation process be so complex, expensive, and time consuming that not one in 10,000 illegals ever gets deported.

It is not a coincidence, that since this country first allowed Mexico to export it’s poverty, in the form of illegal workers, the real wages of the American worker has stagnated. The 'high speed' treatment we need to give to these illegals is a high speed bus home. We are not allowed to simply walk into their countries and begin working and receiving the benefits of their health and welfare systems, why should they be allowed to do that here? Country's have a right to maintaining their borders and demographic profiles. They have a right to 'vet' prospective citizens for disease and criminal records before considering them for citizenship. Why do so many Americans insist that we don't have that right? Why don't Americans value their citizenship enough to feel it is worth protecting?

Joe, its not America - just a small group of people who have a lot of hate in their hearts. They think that the undocumented immigrant is draining public resources. Perhaps some do - but the majority do not. Most adult workers just want peace and an opportunity to make something of themselves. Now, the packing company is the one that hired these undocumented, they did not threatened to kill anyone by cutting and packing the meat a lot of these heaters eat on their barbecues. Probably half of their low priced discounted groceries come from a place that uses low wage undocumented immigrants. The report simply states that the laws that are used on this country were not followed or abused by not following proper procedure. It does not state that those charged were innocent - on the contrary - it states they knew they were guilty of being undocumented. Newsday was not trying to defend them - its just reporting on one more place where fear once again won.
Lets stop being so negative and be more positive. Think of ways to make solutions and avoid falling into fear. Fear is the true enemy - not an undocumented alien, for everyone is a descendant of an immigrant.

i think what newsday and many other media outlets are trying to point out are that there are many undocumented immigrants living and working in american communites. this is a huge issue and being dealt with in extremes. we need to think rationally here.
immigrants are providing services american communties and no matter how much money is spent on enforcement or boarder security there will always be employers who hire undocumented people en masse because they need the labour. no amount of enforcement or punishment will stop this cycle.
we need to find ways to have these employed immigrants pay into the tax system and gain their documentation. We need to further integrate new immigrants into society by expanding english as a second language opportunities and having social services which teach new immigrant the laws so that they fully understand how to abide by them. in addition to enforcing the immigration and labor laws the federal government already has we need to look at expanding ways working immigrants can obtain legal residency or citizenship.
imprisionment is not the answer, that is truely a drain on resources. immigrants are living in and working in america, contributing to their communities and keeping areas like long island alive.
Examples of the advocates of open border policy championed by the Democrats and Newsday include "Deb" the illegal immigrant who advises the overwhelming majority of Americans who oppose illegal immigration to "go f--k yourselves" and who argues no government has the right to prevent her from crossing the border and Dave who uses the old liberal prop that those who disagree with the goal of universal citizenship are just a "small group of people with a lot of hate in their hearts.' Funny how progressives cry foul when their patriotism is impugned but have no compunction to label anyone with an opinion adverse to theirs to be motivated by hate/racism/sexism etc. The undeniable fact is the US takes in more legal immigrants than any other nation in the world. Studies show illegals burden our welfare system (schools, hospitals social benefits etc) and keep wages down. Illegals come to the US solely for employment and without any desire to become citizens otherwise they would have legally applied to immigrate rather than cheat those foreign applicants who properly seek admission.

In your self righteous and selfish way, you reserve to yourself the right to decide which laws should be enforced and obeyed and which ones should be ignored.
I would suggest you are not that important, and not that wise to make such a determination. If you feel a law should be ignored and remain unenforced, then you must extend that right to every individual, even if the law THEY choose to violate is one you agree should be enforced.

Of course, we have not even explored the fact that supporting illegal immigration is similar to supporting slave labor. If you think paying someone $7 per day and forcing them to work in unsanitary and often dangerous conditions, with no where to turn for help is a campassionate act, then why do you not extend that same right to an American Citizen who agrees to work for the same compensation by demanding repeal of minimum wage laws?
