Congratulations, Tom, and best of luck.
From your former (1998) Assembly election opponent.
Let's see if Spitzer shows any class and congratulates Tom.
Will Suozzi now take a high level job with Spitzer paving the way for Spitzer to appoint Weitzman County Executive?
Shimmel for DiNapoli's spot?
The Governor does not appoint a Nassau Exec vacancy--the Nassau charter gives the County Legislature that responsibility. But I don't think an vacancy will occur--Suozzi still has a lot of pennance to do for attacking Eliot's father and the Spitzer family!
YES!!!! Justice Prevails!!!
Congrats Tom.
There is no more ethical person on the planet than Tom DiNapoli.
New York wins!
Was the election of Tom Di Napoli today in compliance with the Sec 41 of the public officers Law
When a vacancy..........The two houses thereof by JOINT BALLOT, shall appoint a person to fill.........
But was he appointed by "JOINT BALLOT"
If one reads MASONS LEGISLATIVE MANUAL Sec 536 Voting by BALLOT
Par 2. Where the.......Where an election by ballot is required each member rising and announcing the members choice as that person's name is called is not a compliance with requirement.
See legal sit Conn vs Starr (1906)
In Marino vs Weprin The
Appellate Court 3rd Department
Makes a point regarding "JOINT BALLOT"
But nobody has ever objected to the fact that they vote by Members announcing their choice, not by "JOINT BALLOT"
It would be interesting to see if a law suit against this election by Members announcing their choice not by casting a "JOINT BALLOT" would nil and void the election.
I'll bet Suozzi is kicking himself over what might have been ... State Comptroller Suozzi.
Howard Weitzman got zero votes. The legislature was unanimous on his abilities!
Spitzer has absolutely no class at all. He was happy to use DiNapoli to get what he wanted (the early endorsement for Governor in Suozzi's back yard), but can't seem to see that DiNapoli is the best person for the Comptroller's job (by virtue of his encyclpedic knowledge of NYS Government and his ability to get things done and work in a non-partisan manner), even after Spiter tried to rig the outcome with the "independent" panel.
Spitzer's antics are exactly why Suozzi is not the State Comptroller right now. Two spoiled rich kids who throw tantrums when they don't get what they want, when they want it.
Spitzer does NOT deserve to get everything he wants. Its a good thing to have a fair and reasonable person like DiNapoli keeping an eye on the Governor and his appointees. Spitzer has shown in the past he is willing to bend things to the point of breaking (the law on occasion? Remember his first election with daddy's money?) then to get his way. We elected a governor, not a king.
DiNapoli will be Comptroller long after Spitzer and Suozzi are gone. DiNapoli may even BE the governor one day. DINapoli has shown class and statesmanship ever since he's been an 18 year old elected school board member. Spitzer could learn a thing or two about how to be an adult from DiNapoli.
