Death Row Dog Goes to the Appellate Division
A press conference and gathering will be held on Monday April 9th at 10:30am at the Islip Town Animal Shelter regarding “Duke” a 6 six year old American Pit Bull Terrier that has been on death row at the Islip Town Shelter for 3 ½ years after an order entered February 2004, ordered Duke to be killed pursuant to section §121 of the Agriculture and Markets Law. Duke’s owner alleges that it was a case of mistaken identity that lead to a dangerous dog complaint filed by a neighbor alleging his bull dog was injured by Duke in 2003. Duke’s attorney, animal welfare attorney, Amy Chaitoff, claims that this is not only a case of misidentification, but legally Duke’s order of destruction is based on a misapplication of New York State Dangerous Dog Law Sections 121 and 108, in effect at the time of the alleged incidents, which specifically excluded dog on dog attacks. The law was amended in December 2004.
Duke’s caretakers at the Islip Town Shelter have grown to love Duke and have filed affidavits in support of Duke regarding their observations of the pound prisoner. Through their 3 ½ year relationship with Duke Islip Shelter staff have found Duke to be a very friendly dog that has never shown any aggression toward other animals or people in the 3 ½ years he has been observed and evaluated at the Islip Shelter. In fact, Duke has also been evaluated multiple times by not only the staff at the Islip Town Shelter but by well known local animal behaviorist Jeff Kolbjornson of Elite Animal Trainers, that has been in support of Duke from the beginning. Duke’s case is currently before the Appellate Division requesting the Appellate Division to vacate the euthanasia sentence based on the District Court’s alleged misapplication of the Agriculture and markets Law in effect during the time of the incident in 2003. Please come and give Duke some good press as it may be the only thing that saves his life after such a long struggle! Thank you.

Denise - Thank you as always for helping us with our animal fights for fairness. This post was really needed to make people aware of today's importance in Duke's life.

Things just have to go right for Duke. I will totally lose my faith in the system if it does not. If this were my dog I know I would plan a breakout for him and no one would ever find me before I let them euthanize an innocent dog. I know I should not say that but trust me I could not live with myself for letting that happen to my dog especially such a sweet boy like Duke. My prayers are with you Duke and all the people working to save him.

The idiots who are posting negative things don't know a thing about the case, they are just blah,blahing.

I wrote 2 posts in support of Duke, stating that his owner is paying his room and board, not the taxpayers.
Well, both of these got flagged.

Now you see why Duke is in the predicament he is in. Too many Long Islanders have been driven mad by the taxes here and EVERYTHING is a threat to their wallets and they go crazy!

The fact that the Court system has moved so slow on this case is a travesty of justice in itself. To euthanize this animal who has repeatedly been shown to be non-aggressive would be an even further travesty of justice. There are children involved in this case. Do we want to send such a terrible message of injustice to these children by euthanizing their pet.
Why is this dog convicted and sentenced WITHOUT any evidence this was him who was the attacker?

I've followed this "case" for almost a year. I saw all the good things that were said about Duke. The people at the "jail/shelter" where he's been for these past 3 years have nothing but good to say about the dog. He is always wagging his tail when he walks through the facility with people...he's not aggressive towards the other dogs who are contained. A dog behaviorist evaluated Duke and the dog passed with flying colors! If the owners paid the neighbor who claimed the dog bit his bulldog close to $9,000, Duke would be home, but for how long? Whats to say the same neighbor wouldn't come up with another charge..
I say let Duke live! He's a sweet dog, loved by his family and many other people!

i just got a call from someone at elite animal training (jeff was out of the office). here's the times and channels that duke's press conference will be on:
- channel 12 (local station) - 5:00 pm
- channel 7 (abc) 5:30 pm news
- channel 29 (must be a local channel - i don't have it) - 7:00 pm
- channel 55 - 11:00 pm
the story will also be in tomorrow's newsday and daily news papers

I actually liked the fact that the writer put "Dangerous Dog" in quotes because it makes it look like the "dangerous dog" part is alleged ... like the reporter does not 100% believe Duke really deserves to be regarded as dangerous.

In an unrelated incident, Artest was arrested March 5 on suspicion of domestic violence at his Loomis home and using force to prevent his victim from reporting a crime.
In the case involving Socks, the county has entered into a foster care agreement that requires the attorney to find an appropriate home for the dog.
The document states that the dog may not be released to Artest and that the county must be notified immediately regarding any changes in the pet's health. The county may also reclaim the dog at any point.

I visited the Islip Shelter in October 06 to adopt an animal( I don't believe in "purchasing" an animal, when there are SO many that are on death row.
I came across Duke, played with him through the gate, and even let him kiss me. I have never seen a more friendly little mush!! When the caretakers told me about Duke, my heart sank. How can such a beautiful, GENTLE animal, be confined to a CAGE for this long, and still look at humans with such kind, and gentle ease. This dog was an angel. This poor thing was dealt a horrible hand, and now these inhumane, heartless people are dangling death in front of him. Doesn't our society have better things to do than to continue torturing this beautiful creature? Right then and there, i wanted this dog, but unfortunately, this poor guy was in the "dog house". I went home, and looked at my beautiful dog i brought home that day. It honestly broke my heart to know Duke is wanted by SO MANY people, men, woman, children, elderly, and someone is deciding his fate. He's been locked up for this long, without a free yard to run in, or a couch to be cozy on, yet his outlook on life should be mirrowed by all men, woman, and children. Here he is, giving an unfair hand at life, and yet, he still smiles. he's fighting to live. But without a solid voice, he might not be heard. I urge any animal lover, any decent human being, to stand up for Duke, and be his voice. Afer all, he's shown us his heart and soul, this is the least we can do..

Hi, just wanted to let you know I work with a rescue organization, Pet Rescue in Larchmont www.ny-petrescue.org
If you need help in getting all those pups a home go to the website and check out the organization, we just celebrated our 25th anniversary. We only work with foster home, no shelter, plenty of human contact. Monica let me know, we can talk about it if you need help. We are very thorough in getting homes for our dogs.
Heavenly Father, we ask You to be present with Denise and her attorney (and with Duke) as this proceeding occurs in the Court today.
We ask you to touch this Judge's heart with the compassion needed to return this, Your Creature Duke, to his family and especially to these sweet children who love him so much. We ask the Court system to show these children how precious our Judicial System is and how fair it can be by releasing Duke today from his bondage at the shelter.
Thank You, Heavenly Father. Thank You for our prayers which will be answered today. Thank You and please bless all those who have worked so hard for this, Your Creature Duke. Bless Denise, her attorney, her family, the people at the shelter who have shown love for Duke and made his stay more pleasant, and for all the others who have fought for this sweet boy, especially Rooby and the weenie crew. hey regina i just caught up and - THANK YOU FOR YOUR OFFER OF HELP!!!! i have since found out that we got 6 of them. from the two links jill had, it's the ones called gorgeouslitter. at the last minute (right before us), a shelter saved the labs. SOOOO - very soon, they'll be that little motley crew at north shore animal league in port washington. i'll let you all know when in case anyone wants to go see/adopt them!!!!!!

here's the story in a nutshell:
i was sitting at my desk minding my own business when our friend jill sends me an email. this email is about a shelter in georgia. this shelter is a kill shelter and when time is up it's up...
anyway this email had almost 20 DOGS who were in "danger" that day. (i'm sorry but bluntly it means that if no other shelter took them, they would have all been euthanized at 4:30 yesterday afternoon!!!!!!!!). (talk about heart wrenching seeing their faces... - they burn a hole in your heart...) when this happens, this woman jayne (wonderful soul) emails all the rescues she can think of asking for help. jill (paws for life) gets these emails too. well right now, they're full to the max so she forwarded it to me because i've dealt with sean casey animal rescue a couple of times. in other words, any effort was being made to try to help. WELL i sent it to sean casey. then debbie suggested to try bonnie and so i forwarded it to her (ruining her day by the way... hehe). bonnie got me in touch with a very nice man at north shore animal league who said they would take the puppies for sure. i have to say that by now it was about 2:00 pm and i found out that all that were left to be saved were two puppy litters. ALL the other dogs were saved by shelters already!!!! (YES THERE WERE 3 LITTERS OF PUPPIES IN THE GROUP OF 20+ THAT WERE GOING TO BE PUT DOWN!!!!!!!) now it was a matter of getting north shore to contact the georgia shelter and let me tell you THANK GOD FOR EMAIL!!!!! i was a basket case as 4:30 QUICKLY approached. (no work was getting done for sure!!!) i finally got north shore and jayne put a "hold" on the puppies and they are safe!!! the only thing north shore requires is that i figure out how to get them from georgia to new york (jayne is helping me on that) and that they are medically checked (parvo, etc...) (jayne is also helping me on that)...
that's about it - they're safe and will be heading to ny in the near future!!! i can't wait to see them in person - those little boogers caused me to lose about 20 years of my lifespan yesterday!!! but boy did it feel good when i drove home!!!
debbie and darlene are familiar with this feeling - we've been put through it already over the past few weeks!!!! it sucks while you're frantically going through it but it feels GREAT afterwards!!!!!

YES!!!!!!!!!!!! Stiffer penalties for these scum..... This is where we have to strike. I was talking to Rooby about this just yesterday by e-mail. WE HAVE TO GET THESE LAWS STRONGER TO PROTECT ANIMALS. We need an attorney fighting for changing so many of these animal rights laws. The Judges can only do so much without the laws to back them up on their sentences!

This is Heather McGrath, long time manager here at the Last Chance
Corral, with the latest update on Foal Rescue 2007. We are, as I speak
heading to Kentucky for 11+ new orphans!!!! The question is, "Can we
feed them, and for how long?" The funding is simply just not keeping up
with the babies. They're going to eat us out of house and barn!!! So, we
are writing in yet another plea to help us help them. NO FEED/MILK=NO
MORE BABIES!!!! We will not take any more than we can support!!!
ANYBODY UP FOR THE CHALLENGE!!! PLEASE THEY/WE NEED YOUR HELP!!!!

Nina Shaeffer of the Pennsylvania Dog Federation has informed us that there will be a protest on Friday at the dog show in Harrisburg by Tammy Grimes
and her cohorts from Dogs Deserve Better. These are the same people who have gone into people's yards and taken dogs stating the dogs have been abused.
Presently Ms Grimes will stand trial in Altoona, PA for dog snatching.
It is imperative that you not leave your dogs unattended at any time and I would strongly suggest that you not leave them unattended at any point
during the weekend. These people are looking to cause trouble and let's not allow them to use our dogs to do it.
Their "scheduled" protest is on Friday from 9:30am to 12:30pm but I can tell you they are probably there to cause problems for us all weekend."
My sentiments:
It's mind boggling that with all the horrible puppy mills in Pa. this AR group is targeting pampered well kept show dogs!
Gimme a break, obviously they are doing this for publicity as the Harrisburg cluster of shows is a very popular venue with large entries and it's televised. Let's hope no dogs or exhibitors suffer any sneaky acts of terrorism at the hands of this group.

I found the blog and put in my vote for Duke. You go, girls! So many people are showing their compassion towards Duke. Also the story of the horse, Champ, in Texas who got stuck in mud this morning and was finally pulled out early in the afternoon by those heroic rescue workers and fellow horse people. It made my day to see Champ walking on his own with them.
